Asylum - What is it & How Can You Apply?

  1. Affirmative Asylum: This is for individuals who are not in removal proceedings. You proactively apply for asylum through U.S. Citizenship and Immigration Services (USCIS) by submitting Form I-589 within one year of your last arrival in the U.S. If your application isn't approved and you don't have legal immigration status, your case will be referred to an immigration judge for a hearing.  uscis.gov

  2. Defensive Asylum: This applies when you're in removal proceedings and use asylum as a defense against deportation. You can request asylum during your hearing with an immigration judge at the Executive Office for Immigration Review (EOIR). The judge will hear arguments from both you (and your attorney, if you have one) and the U.S. government, represented by an attorney from U.S. Immigration and Customs Enforcement (ICE). If the judge grants asylum, you can remain in the U.S.; if not, the judge will determine if you're eligible for other forms of relief or order your removal.  uscis.gov
